By using the site, downloading content and/or using any of the images you are indicating your acceptance and agreement to these terms.

The Full Montage Ltd reserves the right to update or amend these terms and conditions at anytime and without notice. If you continue to access or use this website after any changes are made it will be deemed that you have accepted these changes.

All materials on this website are the property of The Full Montage Ltd, or its licensors, and are subject to intellectual property rights – such as copyright, trade-names, internet domain name.  Any use of these materials is prohibited unless you have received authority from thefullmontage, or purchased the appropriate Content License for use of a specific image or images.

If you obtain a Home Content License Agreement then images may only be used for your own, non-commercial, personal or educational purposes. A Commercial Content License Agreement allows images to be used for commercial purposes, such as for advertising or editorial use.
If you believe any work on the site constitutes copyright infringement or you believe your intellectual property rights have been violated please email us at info@thefullmontage.com.

Personal information


The Full Montage Ltd respects your privacy and undertakes all reasonable steps to protect your personal information. We will only collect personal information about you with your consent, such as when you register for an account, make a purchase or contribute any content. Your personal information will only be gathered and used as set out in the Privacy Policy.


Other/Non-personal information


We may automatically collect non-personal information about you, such as the type of browsers you use or the website from which you linked to us. This information is only used to assist us in providing an effective service on the website.

The Full Montage Ltd also uses “cookies” to help us track how visitors use our site.  We use this information in order to improve our services to you, plan future products and measure overall site effectiveness.  The cookie can also help facilitate your use of the website, ensuring that you do not need to re-enter your details on each visit.  If you would prefer not to use cookies then you can adjust your browser settings to decline them. Whilst the majority of this site is accessible to people of all ages, we only accept orders from persons aged 18 or over.

Whilst we make all reasonable steps to ensure the safety of the site, thefullmontage will not be held responsible or liable for any software, computer viruses or harmful files that may impact your use of your equipment or property as a result of use of this site. thefullmontage therefore recommends that you ensure anti-virus or protective software is installed on your computer system.


Site conduct


This website should only be used for lawful purposes and you agree not to attempt to gain unauthorised access to any thefullmontage user accounts, computer systems or networks associated with thefullmontage.com.

In addition images should specifically not be used for obscene, pornographic, immoral or for libelous purposes.


Site upkeep and maintenance


The Full Montage Ltd reserves the right to remove, update or replace Content at anytime for any reason.
In addition thefullmontage is not liable for any loss you may incur as a result of updates or maintenance to the site.


Warranty


The information provided on this site is "as is" with all faults and without warranty of any kind, expressed or implied, including those of merchantability and fitness for a particular purpose, or arising from a course of dealing, usage or trade practice. thefullmontage makes no warranties or representations regarding the accuracy or completeness of the information. The Full Montage Ltd and its contributors shall not be liable to you for any general, special, direct, indirect, consequential, incidental, or other damages arising out of the rights granted herein.

Limitation of Liability


You assume all responsibility and risk for use of this website and any materials you might use.
The Full Montage Ltd shall not be liable for damages in connection of any claim arising under or out of these terms of use (including without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) or of the use of any Image or Images you may have purchased. 


It should also be noted that whilst most of the images can be used with any version of Photoshop, to use readymade objects you need Photoshop CS2 or higher. Earlier versions of Photoshop will not be suitable. The Full Montage Ltd accepts no liability for any users who are unable to use the images because of incompatibility with your software.

Indemnity


You agree to indemnify and hold The Full Montage Ltd harmless from any and all claims, liabilities, damages, costs and expenses, including reasonable legal fees, arising from the use of an Image or any breach of this agreement.


Term of Agreement


This agreement is effective until terminated. You may terminate this agreement at any time. thefullmontage may at any time change, suspend or discontinue all or any aspect of the Site, including the availability of any Content or User Accounts, without prior notice or liability.


Governing Law


This agreement shall be governed by the laws of England. Any and all disputes arising out of, under or in connection with this agreement, including, without limitation, the validity, interpretation, copyright claims, performance and breach hereof, shall be settled by arbitration in London, England pursuant to the rule of the English Courts.

Content license agreement (home users)

This agreement is legally binding and outlines the terms by which customers of thefullmontage obtain the right to use photographic and illustrative content for personal or home use only.  If you plan to sell your work or the image(s) is/are being used for commercial reasons, such as advertising or editorial work, then you should obtain a Commercial Content License Agreement.



Use of images

This license allows non-exclusive, unlimited use of the image(s) for non-commercial, personal or educational purposes.  All images are suitable for electronic use and in print and all people images come with the appropriate model release.  All images with transparency or our readymades can only be supplied as flattened images.

You are not permitted: 

  • To use the image(s) for any obscene, pornographic, immoral or libelous purposes or use any people images/portraits to depict sensitive matters e.g. mental health, sexual health issues, drugs or crime.
  • To transfer this license or the downloaded image(s) to another individual or assign any further rights for any further use of the image(s)
  • To use the image(s) in such a manner that would enable a person to extract access or reproduce the image(s) as an electronic file. 
  • To remove or delete any notice of copyright or other information that may be embedded in the Image(s) or any file that is uploaded. 
  • To use the image(s) for any commercial purposes, such as advertising or editorial

Purchase of and download of images

The download from this site of one copy of the chosen image(s) can only take place once it has been paid for and you confirm that these terms have been read and agreed upon.

Payment should be made using PayPal.  Upon confirmation of your order you will be directed to PayPal to complete your transaction.  Once your order has been processed and the download of your purchase image(s) is complete we are unable to provide a refund.

Please note that any after-sales service will be conducted in the English language.

Term of agreement

This agreement is effective until either party terminates it. You can cease to use the content at any time and terminate the agreement by destroying the image(s), including any copies or archives of it.

The agreement also terminates without notice from thefullmontage if at anytime you fail to comply with any of its terms. Upon termination you must immediately cease using the Content, destroy or delete all copies or accompanying materials and if requested confirm to thefullmontage in writing that you have complied with these requirements.

In addition, if any image(s) is/are removed from the site and a license for use has already been granted, we reserve the right to terminate the agreement.  In this instance we will notify you by email and upon notice, you agree to no further use of the image or images, including from works that already exist and will destroy the respective image.  In this instance a full refund will be provided.  

Updates and amends to license

thefullmontage reserves the right to amend or update the license granted under this agreement for any reason.  Any updates or amends will automatically replace any previous license provided, and you will be notified either on the website or by email to any changes.



Warranty

Content license agreement (commercial users)

This agreement is legally binding and outlines the terms by which customers of thefullmontage obtain the right to use photographic and illustrative content for commercial purposes, such as in advertising or editorial work.

Use of images

This license allows non-exclusive use of the image(s) for commercial purposes.  You are the only party permitted to use the downloaded content, although you may transfer files containing content to your client, printers or a third party for the purpose of reproduction only. 

All images are suitable for electronic use and in print and all people images come with the appropriate model release.  All images with transparency or our readymades can only be supplied as flattened images.

This Privacy Policy sets out how The Full Montage Ltd, trading as thefullmontage, will use any personal information we collect from you or you provide to us as a result of your use of this website.  We respect your privacy and will take every reasonable step to protect your personal information.  

By using the site you consent to the collection, use and disclosure of your personal information in accordance with this policy.


Gathering and using personal information - customers

We collect and use personal information in order to:
  • create and manage your thefullmontage account 
  • process any purchases you make 
  • communicate with you about our company or to provide details of special offers (if consented by you)
  • undertake research and analysis to help us understand our users, so that we may provide you with relevant and useful information and content 
In order for us to carry out the above we need to collect personal information from you, including name, personal or business address, email address and telephone number.  This information may be collected from you either when you register for an account or when you make a purchase.

Registered users and password protection


By registering for an account this will enable you to view your order history, download your purchased images from your account and benefit from special offers we may from time to time offer registered users.  If you set up an account you will also be asked to choose a username and password, which you are required to keep confidential. 

Your account information is password-protected in order to help keep your personal information secure. 
Thefullmontage does not have access to individual passwords, although it is possible for them to be reset.  If you forget your password or username you can get a reminder by clicking on the ’forgotten?’ link next to the login box.

Ordering your image(s) and completing your transaction 

When you place an order on our site, we will ask you to provide certain information (name, personal or business address, email and telephone number) in order to help us complete the transaction.

If you have already registered an account you will have already have provided us with this information and so will be asked to login to your account, if you have not already done so.

If you do not have an account you will be given the option to either register an account or if you would prefer to make a one-off purchase you will be able to complete your details on the order form.  

Having finalised you order you will be directed to PayPal to make your payment. This will open in a separate window and you will be able to complete your transaction and pay for your purchase. You can either pay by credit card or via your PayPal account (if you already have one).  thefullmontage does not have access to any of your credit card or PayPal account details. 

Once your payment has been accepted you will return to the site where you will be able to download your image(s).  You will also be sent an email with confirmation of your order, and details of how to download your image(s), which you will be able to download within 24 hours of your order.

Special offers and marketing communications

We may from time to time provide details of special offers or details of images that we believe may be of interest to you.  If you would prefer not to receive offers or communications from us then you can request to "opt-out" either by clicking the “opt out” button at the point of registration or point of purchase, or at any time by following the instructions in the email message.  Please note that if you choose to opt out you will still receive emails from us relating to any purchases you make.


Gathering and using personal information - contributors

If you are a photographer who would like to contribute to the site, we will request the following personal information from you: name, email and telephone number.  This information may be used to get in touch with you about your images and to confirm whether you have been selected to contribute to the site.

If you are then selected to contribute we will retain this information and may also ask you for your address details and banking or PayPal account details in order for us to compensate you for any use of your images. 
If you are not selected to contribute to the site then your personal information will be deleted from our records.


Children 

We do not intend to solicit or collect personal information from children (persons under the age of 18) and therefore ask that children do not register for an account or submit personal information to us.  By registering for an account or providing personal information to us you warrant that you are 18 years of age or older.


Non-Personal Details

We do not share or disclose your personal information to any other third parties.  thefullmontage reserve the right to disclose your personal information if required to do so by law.
